While it’s possible to copy other websites’ disclaimers, they will not be specific to your activities. This can leave you open to legal liabilities if they contain the wrong information.

What are the benefits of a disclaimer?

A disclaimer will help to limit any liability from site visitors suing you for losses which may result from things such as:

  • Incorrect interpretation and reliance on information
  • Misleading content – especially if it’s provided by someone else
  • Defamatory statements not written by you
  • Transmission of computer viruses
  • Links to other websites

However, a disclaimer is not a ‘catch all’. You are still responsible for ensuing that information on your website is accurate and not misleading in any way.

When are disclaimers most effective?

The most effective disclaimers are ones where you can prove that you have brought them to the attention of the user. This is best achieved by having a tick box that states that they have read and accept the disclaimer.

However, having it prominently displayed on your site so that it is easily found is another way of demonstrating that the user accepted the risks of the site.
